Terms and Conditions

These Terms and Conditions ("Terms") govern your use of educational and consulting services—including consultations, webinars, mentorship programs, digital products, and all related content and communications—provided by Dr. Roman N. Fomin ("Provider," "we," or "us"). By accessing, purchasing, or participating in any offerings presented through this website or affiliated platforms, you ("Client," "Participant," or "you") agree to be legally bound by these Terms, regardless of your country of residence.

1. Nature of Services

All services are educational in nature, designed to deliver scientific, strategic, and performance-related insights. They do not constitute medical, therapeutic, or clinical services. No diagnosis, treatment, or healthcare is provided or implied.

2. Eligibility

You confirm that:

• You are at least 18 years of age

• You have the legal capacity to enter into a binding agreement

• If acting on behalf of an organization, you are authorized to bind that entity to these Terms

3. International Use

Our services are offered globally. If you access or purchase our services from outside the United States, you are responsible for compliance with local laws. You agree that:

• These Terms are governed exclusively by U.S. law (see Section 20)

• You will not assert foreign consumer rights that conflict with these Terms

• We do not guarantee availability in all countries or regions

4. Scheduling and Service Delivery

Scheduling requirements vary:

• Consultations: You must provide 2 time slots within 7 days and confirm your time zone and objectives

• Mentorship: Schedule is confirmed upon formal acceptance

All services are delivered by Dr. Roman N. Fomin unless otherwise stated. Pacific Time (U.S.) applies unless explicitly agreed otherwise.

5. Payment and Refund Policy

All purchases are final, non-refundable, and non-transferable.

No refunds will be issued for:

• Missed sessions or scheduling conflicts

• Non-attendance

• Dissatisfaction with content

• Currency differences, VAT, or transaction fees

• Lack of engagement

You are responsible for all applicable taxes and transaction charges. Services may not be gifted, reassigned, or resold.

6. Webinar Terms

Registering for a webinar grants a revocable license to access a scheduled educational event.

You agree that:

• You are purchasing access to an event, not the content itself or specific outcomes

• No warranties are made regarding the usefulness, quality, or applicability of content

• No refunds or credits will be issued under any circumstances

• Access credentials are non-transferable and may not be shared

7. Consultation Terms

One-on-one, scheduled advisory sessions.

You agree to:

• Arrive on time and be prepared

• Use the session strictly for developmental and educational purposes

• Not record, replicate, or distribute the session

• Forfeit the session if missed without notice

8. Mentorship Program Terms

The mentorship program is selective and intended for advanced engagement.

You agree to:

• Participate only after official acceptance

• Adhere to all scheduled interactions

• Keep all content strictly confidential

• Accept full responsibility for your implementation and results

• Acknowledge that no outcomes are guaranteed

• Understand that breach of terms may result in immediate removal without refund

9. User Conduct

You agree to:

• Engage respectfully and professionally

• Not disrupt sessions or misuse the platform

• Not record, reproduce, or share proprietary content

Violation may result in immediate revocation of access without refund.

10. Intellectual Property

All content, materials, and frameworks are the sole intellectual property of Dr. Roman N. Fomin.

You are granted a limited, non-transferable license for personal/internal use only. Unauthorized distribution or reproduction is strictly prohibited.

11. Confidentiality and Data Usage

All interactions are treated as confidential. However:

• They are not protected under HIPAA

• Anonymized data may be used for research, service development, or performance analytics

12. GDPR Compliance (EU Users)

If you reside in the European Union, you are protected under GDPR. You have the right to:

• Access your personal data

• Request corrections or deletion

• Withdraw consent or restrict processing

All data is stored securely on U.S. servers.

13. Third-Party Platforms

We use external platforms (Zoom, Stripe, Podia, etc.) for delivery and payments. Use of these platforms is at your own risk. We are not responsible for their outages, technical failures, or policy changes.

14. Force Majeure

We are not liable for any failure to deliver services caused by:

• Natural disasters

• Internet or platform outages

• Acts of war, cyberattacks, or regulatory shutdowns

• Personal emergencies or events outside our control

15. Recordings and Limited Access

If a recording is made available:

• It will be time-limited and view-only

• Downloading, copying, or distributing is prohibited

• The Provider may use anonymized segments for educational or promotional purposes unless you opt out in writing

16. No Guarantees or Warranties

All services are offered as-is, without any promises or guarantees of satisfaction, transformation, or specific results.

17. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages

• Our maximum liability is limited to the total amount paid by you for the specific service

18. Dispute Resolution

In the event of a dispute, both parties agree to:

1. Attempt resolution through good-faith mediation

2. If unresolved, proceed to binding arbitration or litigation in Nevada, U.S.A.

19. Severability

If any clause in these Terms is found invalid, the remainder remains fully enforceable.

20. Jurisdiction and Governing Law

These Terms are governed by the laws of the State of Nevada. Legal jurisdiction is exclusively in Clark County, Nevada, USA.

21. Accessibility

We strive to respond promptly, but cannot guarantee immediate replies. Email is the primary method of communication.
